Fatih SOLMAZ<\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 331. maddesinde ola\u011fan\u00fcst\u00fc fesih hallerinden \u00f6nemli fesih hali d\u00fczenlenmi\u015ftir. \u00d6nemli fesihle ilgili genel bilgi ve hukuki niteli\u011fi birinci b\u00f6l\u00fcmde ele al\u0131nacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a>1.1. Genel Olarak<\/a><\/h2>\n\n\n\n<p>TBK\u2019nin m.331\u2019 de yer alan \u00f6nemli fesih hali \u015fu \u015fekildedir:<\/p>\n\n\n\n<p><em>\u201cTaraflardan her biri, kira ili\u015fkisinin devam\u0131n\u0131 kendisi i\u00e7in \u00e7ekilmez h\u00e2le getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 durumunda, s\u00f6zle\u015fmeyi yasal fesih bildirim s\u00fcresine uyarak her zaman feshedebilir.<\/em><\/p>\n\n\n\n<p><em>H\u00e2kim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flar.\u201d<\/em><\/p>\n\n\n\n<p>Maddenin bulundu\u011fu yer genel d\u00fczenlemelerin bulundu\u011fu k\u0131s\u0131m olmas\u0131 sebebiyle ve ta\u015f\u0131n\u0131r veya ta\u015f\u0131nmaz ayr\u0131m\u0131 yap\u0131lmadan t\u00fcm kira s\u00f6zle\u015fmelerinde uygulanabilece\u011fi \u00f6ng\u00f6r\u00fclmektedir. Ayr\u0131ca bu maddenin lafz\u0131 yorumuna g\u00f6re kira s\u00f6zle\u015fmesinin taraflar\u0131nda bir ayr\u0131ma gidilmeyip iki taraf i\u00e7inde uygulanacak bir hak olarak kullan\u0131labilece\u011fi g\u00f6r\u00fclmektedir. \u00d6nemli sebeple fesih hakk\u0131n\u0131n kullan\u0131m\u0131 i\u00e7in, s\u00f6zle\u015fmenin yap\u0131lm\u0131\u015f olup halen devam ediyor olmas\u0131 \u015fart\u0131 vard\u0131r. Doktrinde \u00f6nemli sebeple fesih hali i\u00e7in, \u2018hakl\u0131 sebebe dayal\u0131 ola\u011fan\u00fcst\u00fc feshi d\u00fczenleyen genel norm\u2019 olarak da kullan\u0131m\u0131 g\u00f6r\u00fclmektedir.&nbsp;<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn1\"><sup>[1]<\/sup><\/a><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;TBK\u2019nin m.331 ikinci f\u0131kras\u0131n\u0131n lafz\u0131 yorumunda \u00f6nemli sebeple fesih hakk\u0131n\u0131 kullanan tarafa, h\u00e2kim takdir durumuna g\u00f6re bir tak\u0131m mali y\u00fck\u00fcml\u00fcl\u00fckler verebilmektedir. Buradan kanun koyucunun \u00f6nemli sebeple fesih hakk\u0131n\u0131 kullanan taraf kar\u015f\u0131s\u0131nda olan feshin muhatab\u0131n\u0131 da g\u00f6zetti\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>H\u00e2kimin takdir hakk\u0131n\u0131 kullan\u0131rken, her iki taraf i\u00e7inde somut olaya g\u00f6re feshin ama\u00e7lar\u0131n\u0131, taraflar\u0131n mali durumlar\u0131n\u0131 ve di\u011fer \u015fartlar\u0131 da g\u00f6z \u00f6n\u00fcnde bulundurarak parasal sonu\u00e7lar\u0131n\u0131 d\u00fcr\u00fcstl\u00fck kural\u0131na uygun karara ba\u011flamal\u0131d\u0131r.&nbsp;<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn2\"><sup>[2]<\/sup><\/a><\/p>\n\n\n\n<p>A\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc ile \u00f6nemli sebeple fesih aras\u0131nda benzerlikler bulunmaktad\u0131r.<strong>&nbsp;<\/strong>Aralar\u0131ndaki en b\u00fcy\u00fck ayr\u0131m uyarlama konusunda ortaya \u00e7\u0131kmaktad\u0131r. TBK\u2019nin m.138\u2019de yer alan a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fcnde taraflara, fesihten \u00f6nce uyarlama se\u00e7ene\u011fi verilmi\u015ftir. TBK\u2019nin m.331\u2019de d\u00fczenlenen \u00f6nemli sebeple fesihte uyarlama se\u00e7ene\u011fi verilmeyip sadece kira s\u00f6zle\u015fmesinin feshi hakk\u0131 verilmi\u015ftir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn3\"><sup>[3]<\/sup><\/a><\/p>\n\n\n\n<p>Doktrinde s\u00f6zle\u015fmenin ayakta tutman\u0131n \u00f6neminden dolay\u0131 uyarlaman\u0131n \u00f6nemli sebeple fesihte de kullan\u0131labilece\u011fi belirtilmektedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn4\"><sup>[4]<\/sup><\/a><\/p>\n\n\n\n<p>Bu konuda dikkat edilmesi gereken husus uyarlama iste\u011finin olmas\u0131d\u0131r. Yani \u00f6nemli sebeple fesih hakk\u0131n\u0131n kullan\u0131m\u0131 durumunda kar\u015f\u0131 taraf uyarlama talebinde bulunmad\u0131ysa h\u00e2kim resen bunu uygulamayacakt\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn5\"><sup>[5]<\/sup><\/a><\/p>\n\n\n\n<p>Devam eden kira ili\u015fkisinde \u00e7ekilmezlik ortaya \u00e7\u0131kmas\u0131 halinde taraflar\u0131n TBK\u2019nin 138.maddesi ve 331.maddesi kapsam\u0131nda se\u00e7imlik haklar\u0131n\u0131n oldu\u011funu kabul edenlerde vard\u0131r. Bunlar g\u00f6z \u00f6n\u00fcnde bulundurularak taraflar, h\u00e2kimden uyarlama veya fesih hakk\u0131n\u0131 talep edebilirler.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn6\"><sup>[6]<\/sup><\/a><\/p>\n\n\n\n<p>TBK\u2019nin 331. maddesinde lafzi olarak bir s\u0131n\u0131r koyulmam\u0131\u015ft\u0131r. Bunun yan\u0131nda kira s\u00f6zle\u015fmelerine dair genel h\u00fck\u00fcmlerin d\u00fczenlendi\u011fi k\u0131s\u0131mda \u0131 olmas\u0131 m\u00fcnasebetiyle,&nbsp;ta\u015f\u0131n\u0131r veya ta\u015f\u0131nmaz fark etmeksizin kiralamada, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda da fark etmeksizin uygulama alan\u0131 bulabilecektir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn7\"><sup>[7]<\/sup><\/a><a><\/a><\/p>\n\n\n\n<p><strong>1.2. Hukuki Niteli\u011fi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>TBK\u2019nin 331. maddesinde d\u00fczenlenen \u00f6nemli sebeple fesih hakk\u0131n\u0131n hareket noktas\u0131 d\u00fcr\u00fcstl\u00fck ilkesinden dolay\u0131 devam eden kira s\u00f6zle\u015fmesinin \u00e7ekilmez hale gelmesidir. \u00d6nemli sebeple fesih hakk\u0131n\u0131n hukuki niteli\u011fi d\u00fcr\u00fcstl\u00fck kural\u0131d\u0131r.&nbsp;<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn8\"><sup>[8]<\/sup><\/a><\/p>\n\n\n\n<p>\u00d6nemli sebeple fesih hakk\u0131; ileriye d\u00f6n\u00fck olup, bozucu yenilik do\u011furan bir hakt\u0131r. Bu haktan dolay\u0131 yap\u0131lan fesih bildirimi ise bozucu yenilik do\u011furan hukuki i\u015flem niteli\u011findedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn9\"><sup>[9]<\/sup><\/a><\/p>\n\n\n\n<p>TBK 331. maddesinde d\u00fczenlenen \u00f6nemli sebeple feshin hukuki niteli\u011fi genel olarak, kira s\u00f6zle\u015fmenin \u00e7ekilmez hale gelmesi durumunda d\u00fcr\u00fcstl\u00fck kural\u0131ndan dolay\u0131 s\u00f6zle\u015fmenin taraflar\u0131na verilmi\u015f bir hak olarak sunulmu\u015ftur. Maddenin ilk f\u0131kras\u0131 emredici nitelikte oldu\u011fu i\u00e7in \u00f6nemli nedenle feshi engelleyici bir h\u00fckm\u00fcn s\u00f6zle\u015fmeye konulamayaca\u011f\u0131 ortadad\u0131r. Fakat feshi kolayla\u015ft\u0131r\u0131c\u0131 h\u00fck\u00fcmlerin kira s\u00f6zle\u015fmesine eklenmesinde bir sak\u0131nca yoktur.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn10\"><sup>[10]<\/sup><\/a>\u00d6nemli sebeple fesih hakk\u0131 engellenemeyece\u011fi gibi bu haktan feragat da m\u00fcmk\u00fcn de\u011fildir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn11\"><sup>[11]<\/sup><\/a><\/p>\n\n\n\n<p>TBK 331. Maddesinin ikinci f\u0131kra ise emredici nitelikte de\u011fildir.&nbsp;<em>\u2018H\u00e2kim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flar.\u2019<\/em>&nbsp;S\u00f6zle\u015fmenin taraflar\u0131, emredici nitelikte olmad\u0131\u011f\u0131 i\u00e7in kira s\u00f6zle\u015fmesine, \u00f6nemli sebeple kira s\u00f6zle\u015fmesini feshedilmesi durumunda di\u011fer taraf lehine tazminat verilmeyece\u011fi h\u00fckm\u00fcn\u00fc ekleyebilir. Bu konuda \u00f6nemli g\u00f6r\u00fclen husus ise tazminattan vazge\u00e7ilebilece\u011fidir. \u00d6nemli sebeple fesih durumunda ortaya \u00e7\u0131kacak zarar\u0131n miktar\u0131n\u0131 s\u00f6zle\u015fmede belirleme hakk\u0131 taraflara de\u011fil h\u00e2kimin takdirindedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn12\"><sup>[12]<\/sup><\/a><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><a>2. \u00d6NEML\u0130 SEBEPLE FESH\u0130N \u015eARTLARI<\/a><\/h1>\n\n\n\n<p>Bu b\u00f6l\u00fcmde kira ili\u015fkisinin devam\u0131n\u0131 \u00e7ekilmez hale getiren sebepler say\u0131lacakt\u0131r. Ard\u0131ndan fesih bildirimi i\u00e7in. Dikkat edilmesi gereken hususlardan bahsedilecektir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a>2.1. Kira ili\u015fkisinin devam\u0131n\u0131 \u00e7ekilmez hale getiren \u00f6nemli sebepler<\/a><\/h2>\n\n\n\n<p>TBK\u2019nin 331. Maddesine bak\u0131ld\u0131\u011f\u0131nda, \u00f6nemli feshin herhangi bir tan\u0131m\u0131n\u0131n olmad\u0131\u011f\u0131 g\u00f6r\u00fclecektir. Tan\u0131m\u0131n yap\u0131lmam\u0131\u015f olmas\u0131n\u0131n esas sebep her olayda \u00f6nemli sebebin de\u011fi\u015fkenlik g\u00f6sterece\u011fidir. Yani her olay \u00f6zelinde farkl\u0131 bir \u00f6nemli fesih kavram\u0131 ortaya \u00e7\u0131kmaktad\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn13\"><sup>[13]<\/sup><\/a><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Her ne kadar kanunda bir tan\u0131m olmasa da her somut olayda aranan bir kriter olan \u2018\u00e7ekilmezlik\u2019 unsuruna bak\u0131lmaktad\u0131r. Her somut olay \u00f6zelinde ili\u015fkinin devam\u0131 i\u00e7in \u00e7ekilmezlik hale getiren \u015fart aranmaktad\u0131r ve bu \u015fart mevcut ise kira s\u00f6zle\u015fmesi \u00f6nemli nedenle fesih yap\u0131labilmektedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn14\"><sup>[14]<\/sup><\/a><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\u00c7ekilmezlik \u015fart\u0131 aran\u0131rken bunun kullan\u0131lmas\u0131 i\u00e7inde d\u00fcr\u00fcstl\u00fck kural\u0131na dikkat edilmesi \u015fart\u0131 vard\u0131r. \u00c7ekilmezlik \u015fart\u0131n\u0131n da kira s\u00f6zle\u015fmesinin devam\u0131n\u0131 a\u00e7\u0131s\u0131ndan bu \u015fart\u0131n taraflar i\u00e7in objektif olarak s\u00f6zle\u015fmeyi \u00e7ekilmez k\u0131lmas\u0131 da gerekmektedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn15\"><sup>[15]<\/sup><\/a>&nbsp;Belirtilen bilgiler kapsam\u0131nda, iki unsur ta\u015f\u0131nmal\u0131d\u0131r: \u00d6nemli sebep ve bu sebebe ba\u011fl\u0131 olarak \u00e7ekilmezlik yaratmas\u0131.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn16\"><sup>[16]<\/sup><\/a>&nbsp;Ayr\u0131ca \u00f6nemli sebep s\u00f6zle\u015fmenin kurulumunda s\u00f6zle\u015fmenin taraflar\u0131 taraf\u0131ndan bilinmemeli ya da tahmin edilmemelidir.&nbsp;<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn17\"><sup>[17]<\/sup><\/a><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin \u00f6nemli sebep ile feshi i\u00e7in sebebin en az bir veya birden fazla olmas\u0131 gibi \u015fart yoktur. Her somut olay \u00f6zelinde bazen bir sebep yeterli olabilmekte iken bazen yetersiz olmaktad\u0131r. Tek ba\u015f\u0131na feshe sebep olamayacak bir durum ortaya \u00e7\u0131kt\u0131\u011f\u0131nda, d\u00fcr\u00fcstl\u00fck kural\u0131na g\u00f6re bak\u0131lmal\u0131 ve s\u00f6zle\u015fmenin devam\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131 aranmal\u0131d\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn18\"><sup>[18]<\/sup><\/a><\/p>\n\n\n\n<p>Tek ba\u015f\u0131na feshe yeterli olan sebepler \u2018mutlak objektiflik unsuru\u2019 olarak ifade edilmektedir. \u00d6rnek olarak: ekonomik kriz, sava\u015f, salg\u0131n hastal\u0131k vb. verilebilir. Doktrinde, sadece ekonomik sebepler, kirac\u0131n\u0131n i\u015fyerini de\u011fi\u015fikli\u011fi, kiraya verenin kapsaml\u0131 tadilat yapt\u0131rmak istemesi gibi durumlar tek ba\u015f\u0131na \u00f6nemli nedenle fesih i\u00e7in yeterli kabul edilmemektedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn19\"><sup>[19]<\/sup><\/a><\/p>\n\n\n\n<p>Tek ba\u015f\u0131na feshe yeterli olmayan sebepler \u00e7ekilmezli\u011fin \u2018s\u00fcbjektif a\u011f\u0131rl\u0131k unsuru\u2019 olarak ifade edilmektedir. Bu unsurun \u00fc\u00e7 \u00f6zelli\u011fi vard\u0131r: \u00c7ekilmezlik unsuruna konu sebebin, \u00f6nemli sebebe dayanarak feshi isteyen taraf\u00e7a bilinmemeli ve\/veya \u00f6ng\u00f6r\u00fclmemeli. \u00c7ekilmezli\u011fe sebep olan unsurun s\u00fcreklilik g\u00f6stermesi gereklidir. Son olarak, kira s\u00f6zle\u015fmesinin kalan s\u00fcresinde \u00e7ekilmezlik g\u00f6sterip g\u00f6stermedi\u011fine ahde vefa ilkesi ve d\u00fcr\u00fcstl\u00fck kurallar\u0131 \u00e7er\u00e7evesinde bak\u0131lmal\u0131d\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn20\"><sup>[20]<\/sup><\/a>&nbsp;Kira s\u00f6zle\u015fmesinin, kalan s\u00fcresinin az kalmas\u0131 durumunda d\u00fcr\u00fcstl\u00fck kural\u0131nca s\u00f6zle\u015fmenin s\u00fcresinin bitmesini beklemek d\u00fcr\u00fcstl\u00fck kural\u0131nca daha do\u011fru olacakt\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn21\"><sup>[21]<\/sup><\/a><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin taraflar\u0131 aras\u0131nda birbirlerine kar\u015f\u0131 su\u00e7 te\u015fkil eden bir eylem olu\u015fmas\u0131 da kira ili\u015fkisinin \u00e7ekilmez hale getirmektedir.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Kira s\u00f6zle\u015fmesinin taraflar\u0131ndan birinin \u00f6tekine kar\u015f\u0131 su\u00e7 te\u015fkil edecek bir eylemde bulunmas\u0131 da kira ili\u015fkisini \u00e7ekilmez k\u0131lacakt\u0131r. Bu eylem sonucunda, sadece kovu\u015fturmaya yer olmamas\u0131 durumunda kira s\u00f6zle\u015fmesinin \u00f6nemli sebeple feshi ger\u00e7ekle\u015fmez. Verilecek herhangi bir ceza durumunda cezan\u0131n a\u011f\u0131rl\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n s\u00f6zle\u015fme ili\u015fkisi \u00f6nemli sebeple fesih yap\u0131labilir. Bu eylemin sadece s\u00f6zle\u015fmenin taraflar\u0131na yap\u0131lmas\u0131 durumunda kullan\u0131labilece\u011fi bir \u015fart yoktur. Taraflar\u0131n aile bireylerine veya yak\u0131n \u00e7evresine y\u00f6nelik olmas\u0131 da fesih i\u00e7in kabul g\u00f6rmektedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn22\"><sup>[22]<\/sup><\/a><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Taraflardan birinin k\u0131s\u0131tlanmas\u0131, akli dengesini kaybetmesi gibi hallerde tek ba\u015f\u0131na hukuki karar alamaz. Lafzi olarak bak\u0131ld\u0131\u011f\u0131nda maddede feshin yap\u0131lmas\u0131 i\u00e7in bildirimin gerekli oldu\u011fudur. Feshin geri al\u0131nmas\u0131na ili\u015fkin beyan, fesih beyan\u0131ndan \u00f6nce veya fesih beyan\u0131 ile ayn\u0131 anda ula\u015fm\u0131\u015fsa ya da fesih beyan\u0131ndan sonra ula\u015fsa bile feshin geri al\u0131nd\u0131\u011f\u0131 fesih muhatab\u0131 taraf\u0131ndan \u00f6nceden \u00f6\u011frenilirse ve feshin geri al\u0131nmas\u0131na muvafakat edilmi\u015fse geri alma beyan\u0131 ge\u00e7erli olabilmektedir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn34\"><sup>[34]<\/sup><\/a>&nbsp;Yenilik do\u011furan haklar\u0131n geri al\u0131namamas\u0131 kural\u0131n\u0131n istisnalar\u0131n\u0131n kira s\u00f6zle\u015fmesinin \u00f6nemli sebeplerle feshinde de uygulanmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p>Fesih bildirim s\u00fcresi TBK\u2019nin 331. Maddesi\u2019nden k\u0131yasen konut ve \u00e7at\u0131l\u0131 i\u015fyeri s\u00f6zle\u015fmeleri a\u00e7\u0131s\u0131ndan uygulama alan\u0131 bulan TBK\u2019nin 329. Maddesi\u2019nde h\u00fckm\u00fcnde \u00fc\u00e7 ay olarak d\u00fczenlenmektedir. \u00d6nemli sebebin varl\u0131\u011f\u0131yla desih bildirimi, d\u00fcr\u00fcstl\u00fck kurallar\u0131 uyar\u0131nca makul bir s\u00fcrede ileri s\u00fcr\u00fclmelidir. Bu bildirimin muhataba tebli\u011f edilmesinden itibaren \u00fc\u00e7 ay ge\u00e7tikten sonra kira s\u00f6zle\u015fmesi TBK\u2019nin 331. maddesi uyar\u0131nca feshedilecektir. TBK\u2019nin 300. maddesi veya TBK\u2019nin 347. maddesi uyar\u0131nca kira s\u00f6zle\u015fmesi yenilenmi\u015fse ancak yenileme d\u00f6neminde ortaya \u00e7\u0131kacak veya yenileme d\u00f6neminde devam etti\u011fi kabul edilecek \u00f6nemli sebep varsa kira s\u00f6zle\u015fmesi feshedile bilinir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn38\"><sup>[38]<\/sup><\/a><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><a>3. \u00d6NEML\u0130 SEBEPLE FESH\u0130N SONU\u00c7LARI<\/a><\/h1>\n\n\n\n<p>\u00d6nemli sebeple fesih ile kira s\u00f6zle\u015fmesi bildirim s\u00fcresinin sonunda sonlan\u0131r. Bu fesih sonucunda fesih bildirimi sonucunda parasal sonu\u00e7lar ortaya \u00e7\u0131kmaktad\u0131r. Bunu belirlemek h\u00e2kimin takdirinde olup taraflar sadece bu haktan vazge\u00e7ebilir. Bu b\u00f6l\u00fcm \u00f6nemli sebeple feshin sonu\u00e7lar\u0131n\u0131 kapsamaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a>3.1. Kira S\u00f6zle\u015fmesinin Sona Ermesi<\/a><\/h2>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin taraflar\u0131ndan biri, s\u00f6zle\u015fme ili\u015fkisinin kendisi i\u00e7in \u00e7ekilmez hale gelmesiyle \u00f6nemli sebeple fesih hakk\u0131n\u0131 kullanabilir. Yasal fesih bildirim s\u00fcresine uyuldu\u011funda kira s\u00f6zle\u015fmesi sona erebilir. Nitekim fesih bildirimi, ileriye etkili olarak kira ili\u015fkisini sona erdirecektir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn41\"><sup>[41]<\/sup><\/a>&nbsp;Kira ili\u015fkisi devam etti\u011fi i\u00e7in taraflar s\u00f6zle\u015fmeden do\u011fan bor\u00e7lar\u0131n\u0131 \u00f6demeye devam etmeleri gerekmektedir.<\/p>\n\n\n\n<p>Yasal fesih bildirim s\u00fcresi ileriye etkili olup, s\u00fcrenin bitmesi ile s\u00f6zle\u015fme sona erer. S\u00f6zle\u015fmenin son buldu\u011fu i\u00e7in art\u0131k taraflar\u0131n bor\u00e7lar\u0131 olu\u015fmayacakt\u0131r. Asl\u0131nda taraf kira s\u00f6zle\u015fmesini sona erdirme d\u00fc\u015f\u00fcncesi mevcut de\u011fildir. Var oldu\u011fu san\u0131lan \u00f6nemli sebep konusunda yan\u0131lg\u0131ya d\u00fc\u015f\u00fclmese fesih hakk\u0131n\u0131 kullanmak isteyen taraf bu hakk\u0131 kullanmayacakt\u0131. Fesih Sebebiyle U\u011fran\u0131lan Zarar\u0131n Tazmini<\/a><\/h2>\n\n\n\n<p>\u00d6nemli sebeple kira s\u00f6zle\u015fmesinin sona ermesi d\u0131\u015f\u0131nda bir tak\u0131m parasal sonu\u00e7lar da ortaya \u00e7\u0131kmaktad\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn48\"><sup>[48]<\/sup><\/a><\/p>\n\n\n\n<p>TBK\u2019nin 331\/2\u2019de \u00f6ng\u00f6rd\u00fc\u011f\u00fc yasal d\u00fczenleme de \u2018<em>H\u00e2kim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc\u0308 fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flar.\u2019&nbsp;<\/em>ifadesiyle kanun koyucunun h\u00e2kime parasal sonu\u00e7lar\u0131 belirleme imk\u00e2n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Maddenin bu hali ile parasal sonu\u00e7lar hakk\u0131nda ayr\u0131nt\u0131ya gidilmedi\u011fi, kusur varl\u0131\u011f\u0131 aran\u0131p aranmayaca\u011f\u0131, ya da parasal sonu\u00e7lar i\u00e7in dikkat edilecek k\u0131staslar d\u00fczenlenmemi\u015ftir. Madde kapsam\u0131ndan anla\u015f\u0131lan h\u00e2kim durum ve ko\u015fullara uygun parasal sonu\u00e7lar\u0131n ne olaca\u011f\u0131n\u0131 serbest\u00e7e takdir edecektir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn49\"><sup>[49]<\/sup><\/a><\/p>\n\n\n\n<p>H\u00e2kime tan\u0131nan bu yetkinin geni\u015f oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Emredici nitelikte olmad\u0131\u011f\u0131 i\u00e7in s\u00f6zle\u015fmede yer alacak bir madde ile taraflar\u0131n \u00f6nemli sebeple fesih halinde tazminat \u00f6denmemesi kararla\u015ft\u0131r\u0131labileceklerdir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn50\"><sup>[50]<\/sup><\/a>&nbsp;Taraflar sadece tazminattan vazge\u00e7ebilirler parasal s\u0131n\u0131r\u0131 pe\u015fin belirleme gibi bir haklar\u0131 bulunmamaktad\u0131r. Ayk\u0131r\u0131 bir durum ortada olmad\u0131\u011f\u0131 i\u00e7in parasal sonu\u00e7 i\u00e7in denkle\u015ftirme bedeli denebilir. Ayr\u0131ca kanun koyucu parasal sonu\u00e7 ibaresi ile bu tan\u0131m\u0131 s\u0131n\u0131rland\u0131rmamay\u0131 d\u00fc\u015f\u00fcnm\u00fc\u015ft\u00fcr. Kanun koyucunun parasal sonu\u00e7 ifadesini se\u00e7erek tazminat kavram\u0131ndan uzakla\u015fmak istedi\u011fi de s\u00f6ylenebilecektir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn54\"><sup>[54]<\/sup><\/a><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Yine kanuna bak\u0131ld\u0131\u011f\u0131nda kusur olgusundan da bahsedilmedi\u011fi g\u00f6r\u00fclecektir. Parasal sonu\u00e7 bulunmas\u0131na ra\u011fmen herhangi bir kusurlu davran\u0131\u015f ile il\u015fki aranmamaktad\u0131r. \u00d6nemli sebeple fesih hakk\u0131n\u0131 kullanan taraf\u0131n parasal sonu\u00e7lara katlanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc i\u00e7in kusur \u015fart\u0131 yoktur. Bu kapsamda sadece \u00f6nemli fesih hakk\u0131n\u0131 kullanan tarafa hakkaniyet ilkesi \u00e7er\u00e7evesinde \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc do\u011fmaktad\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn55\"><sup>[55]<\/sup><\/a><\/p>\n\n\n\n<p>\u00c7ekilmezli\u011fin taraflardan birinin kusuruna dayanmas\u0131 durumunda doktrin h\u00e2kim g\u00f6r\u00fc\u015fe g\u00f6re, \u00e7ekilmezlik unsurunun fesih bildiriminde bulunan taraftan kaynaklanmamas\u0131 gerekti\u011fidir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn56\"><sup>[56]<\/sup><\/a>&nbsp;H\u00e2kimin takdirine ba\u011fl\u0131 parasal sonu\u00e7, maddenin lafz\u0131ndan da anla\u015f\u0131laca\u011f\u0131 gibi parasal (nakdi) bir de\u011fer ta\u015f\u0131mal\u0131d\u0131r. H\u00e2kimin kesinlikle nakdi bir tutar h\u00fckmetmesi \u015fartt\u0131r.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn57\"><sup>[57]<\/sup><\/a><\/p>\n\n\n\n<p>Bunun d\u0131\u015f\u0131nda taraflar\u0131n \u00f6nemli sebeple fesih sonunda zararlar\u0131 azaltma y\u00fck\u00fcml\u00fcl\u00fckleri de vard\u0131r. \u00d6nemli sebeple fesih hakk\u0131n\u0131 kullanan taraf\u0131n kirac\u0131 oldu\u011fu durumlarda, kiraya veren, kiralanan\u0131n en k\u0131sa s\u00fcrede yeniden kiralanmas\u0131 i\u00e7in \u00e7aba g\u00f6stermesi beklenmektedir. Aksi durumda h\u00e2kim, kiraya veren lehine parasal sonu\u00e7ta indirim yapma yoluna gidebilir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn58\"><sup>[58]<\/sup><\/a><\/p>\n\n\n\n<p>H\u00e2kimin parasal sonu\u00e7lar i\u00e7in takdiri serbest\u00e7e yapacakt\u0131r. Bahsi ge\u00e7en m\u00fcspet zararlar, kiraya verenin yeniden kiraya verene kadar kiralanan\u0131n bo\u015fta kalan s\u00fcredeki kayb\u0131, kiraya verenin yeniden kirac\u0131 bulmak i\u00e7in yapt\u0131\u011f\u0131 ek masraflar, kirac\u0131n\u0131n ya\u015fad\u0131\u011f\u0131 ticari kay\u0131plar ve ta\u015f\u0131nma ve yeni kiralanacak yer bulmak i\u00e7in yapt\u0131\u011f\u0131 masraflar, yeni bir kiralama yapmas\u0131 durumunda eski yer ile arada olu\u015fan kira farklar\u0131, yeni kiralanan i\u00e7in ger\u00e7ekle\u015ftirdi\u011fi tadilat giderleri \u00f6rnek olarak verilebilir.<a href=\"applewebdata:\/\/F14E1F16-F6EE-4086-99F5-31A6B4BA225D#_ftn63\"><sup>[63]<\/sup><\/a><\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong>SONU\u00c7<\/strong><\/p>\n\n\n\n<p>Bu \u00e7al\u0131\u015fma kapsam\u0131nda, kira s\u00f6zle\u015fmelerinin \u00f6nemli sebeple sona ermesi hususu irdelenmi\u015ftir. \u00c7al\u0131\u015fman\u0131n kapsam\u0131 esas\u0131nda ana hareket noktas\u0131, TBK d\u00fczenlemeleri olmu\u015ftur. Bu kapsamda, \u00e7al\u0131\u015fman\u0131n neticeleri \u015funlard\u0131r:<\/p>\n\n\n\n<p>\u00d6nemli sebeple fesih, di\u011fer ola\u011fan\u00fcst\u00fc fesih hallerinin kullan\u0131lamad\u0131\u011f\u0131 durumlarda kullan\u0131lan genel kapsaml\u0131 fesih t\u00fcr\u00fcd\u00fcr. Hem kiraya verenin hem de kirac\u0131n\u0131n kullanabilece\u011fi bir hakt\u0131r.<\/p>\n\n\n\n<p>\u00d6nemli sebeple fesih hakk\u0131n\u0131n kullan\u0131lmas\u0131n\u0131n temel \u015fart\u0131 \u00e7ekilmezlik unsurunun varl\u0131\u011f\u0131d\u0131r. \u0130\u015fbu hakk\u0131n kullan\u0131m\u0131 i\u00e7in s\u00f6zle\u015fmenin devam\u0131n\u0131n, taraflardan biri i\u00e7in \u00e7ekilmez hale gelmesi \u015fartt\u0131r. Ayr\u0131ca bu ki\u015finin s\u00f6zle\u015fmeyi s\u00fcrd\u00fcrmesi d\u00fcr\u00fcstl\u00fck kural\u0131 gere\u011fi kendisinden beklenmemelidir.&nbsp;<\/p>\n\n\n\n<p>\u00d6nemli sebeple fesih hakk\u0131n\u0131n kullanan taraf\u0131n, \u00f6nemli sebebin olu\u015fmas\u0131nda veya \u00e7ekilmezlik unsurunun geli\u015fmesinde kusurunun bulunmamas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>\u0130\u015fbu fesih t\u00fcr\u00fc s\u00fcreli bir fesih se\u00e7ene\u011fi olup, s\u00f6zle\u015fme bu feshin kullan\u0131lmas\u0131yla derhal sona ermez.&nbsp;&nbsp;Fesih bildirim usul\u00fc ile s\u00f6zle\u015fme sona ermektedir.<\/p>\n\n\n\n<p>\u00d6nemli sebeple feshin ba\u015fka bir \u00f6nemli \u00f6zelli\u011fi ise, bu fesih hakk\u0131n\u0131 kullanan taraf\u0131n, TBK 331. Madde atf\u0131yla \u015fartlara g\u00f6re h\u00e2kim taraf\u0131ndan takdir edilen bir parasal sonu\u00e7lara uyma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc mevcuttur. \u00d6nemli sebeple fesih durumunda h\u00e2kim, fesih hakk\u0131n\u0131 kullanan tarafa katlanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olan parasal sonu\u00e7lar\u0131, \u00e7ekilmezlik olgusuna ve varsa feshin muhatab\u0131 olan tarafa ait kusura g\u00f6re belirler.
